We do not sell, rent, or trade email lists with other companies and businesses for marketing purposes. We may use and disclose de-identified, aggregated, or statistical information derived from personal data for any business purpose, including but not limited to: analyzing service usage patterns, conducting research, improving our products and services, developing new features, generating insights and analytics reports, debugging technical issues, and measuring service performance. Such de-identified or aggregated information does not identify any individual and cannot reasonably be used to identify or contact any person. We maintain appropriate technical and organizational safeguards in our de-identification process to prevent re-identification of individuals.

Latham will retain your Personal Information for as long as necessary to comply with your request, to comply with any legal requirement, and for as long as necessary to protect our legal interests or otherwise pursue our legal rights and remedies. We may retain your Personal Information for any additional period that may be required or permitted by law, such as for business, legal, accounting, or reporting requirements or pursuant to customer contract requirements. We may also keep your Personal Information on our archive systems in accordance with our backup and disaster recovery policies and procedures. The length of time your Personal Information is retained depends on the purpose(s) for which it was collected, how it is used, and the requirements to comply with applicable laws or customer contracts. Latham may retain data that has been aggregated or otherwise rendered anonymous in such a manner that you are no longer identifiable indefinitely.

Applicable data protection laws may provide you with certain rights with regards to our processing of your Personal Information. Latham respects your rights to access, correct, and request erasure or restriction of your Personal Information as required by law. Depending on your country or state of residence, these rights may include:
- The right to be informed about our collection, use, and disclosure of your Personal Information;
- The right to know if we maintain your Personal Information, and if we do, to access that information (subject to the rights of others) and to request that we provide your information in a portable format. You also have the right to request that we transmit this Personal Information to another controller, when technically feasible;

The right to object to our processing of your Personal Information, including the rights to object to:- the sale of your Personal Information;

With regards to deletion requests, we will only delete your Personal Information when we no longer have a lawful basis for processing your Personal Information or after a final determination that your Personal Information was unlawfully processed. We may not accommodate a request to erase information if we believe the deletion would violate any law or legal requirement or cause the information to be incorrect. In all other cases, we will retain your Personal Information as set forth in this policy. In addition, we cannot completely delete your Personal Information as some data may rest in previous backups. These will be retained for the periods set forth in our data retention policies.
We will not retaliate or engage in discriminatory treatment against you if you exercise your privacy rights.

You have the right to lodge a complaint with the applicable supervisory authority in the country or the jurisdiction you live in, the country or jurisdiction you work in, or the country or the jurisdiction where you believe your rights under applicable data protection laws have been violated. Our Service does not address anyone under the age of 18 (each a “Child”).

IX. California Privacy Rights
This Privacy Policy provides most of the information required by the California Consumer Privacy Act and the California Privacy Rights Act (collectively, the “CCPA”). - Government-issued Identification numbers for employee human resources and benefit tasks including job applicant processing, employee processing, payroll, and other benefits;
- Race, ethnicity, gender and job class for EEOC reporting;
- Account log-in credentials needed to allow you to access your account and for account security purposes;
- Precise Geolocation Data if you authorize our use of precise geolocation data in our applications, including mobile applications through which we will use it to deliver content based on your location;
We do not process any sensitive Personal Information for the purpose of informing characteristics about you.

Financial Incentives: Latham does not offer financial incentives for the collection or sale of Personal Information. We may offer individuals the opportunity to receive free content (such as estimated pricing for certain pool projects) if they register with their email. If you ask us to delete your information, you will not be able to receive new content, but you can continue to use content that was sent to you previously.
X. Additional Information for EEA, United Kingdom, and Swiss Residents
Latham is providing this additional information for the benefit of individuals in the European Economic Area (“EEA”), United Kingdom, and Switzerland, to explain our practices with regard to EEA, United Kingdom, and Swiss Personal Information, to explain additional rights such individuals have with respect to their Personal Information. Latham is the data controller of your Personal Information. Latham is not required to appoint a Data Protection Officer in the EU.
